Liability for Amityville Bus Accidents
Bus drivers must use caution to avoid colliding with pedestrians in the roadway. According to New York Vehicle Code 1146, “Notwithstanding the provisions of any other law to the contrary, every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” There are many errors a driver could make that could contribute to a bus accident.
- A driver may have been traveling at an unsafe speed.
- A driver may have failed to scan the road ahead of them for pedestrians.
- A driver may have made an unsafe turn without checking cross traffic.
- A driver may have been distracted by looking at their phone.
If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, this could serve as evidence of negligence. Liability for any bus accident could extend to several parties beyond a specific driver determined to be at fault. For example, the company that owned or operated a bus could bear some legal responsibility. As a general rule, employers can be vicariously liable for the negligent actions of their workers who are operating within the course and scope of their job duties.
