Pedestrian Injured In Yonkers Truck Accident

Yonkers police officials are saying that the accident took place on Sunday afternoon. The driver of a truck hit a pedestrian and then remained at the scene.

A full investigation into the collision remains ongoing at this time.

Liability For Yonkers Pedestrian Accidents

Thousands of people are seriously injured in pedestrian accidents each year. Pedestrians over the age of 65 tend to be at greater risk of being involved in fatal accidents. According to the Centers for Disease Control, “Adults ages 65 years and older accounted for about 17% of the U.S. population in 2021. However, this group accounted for 21% of all pedestrian deaths in 2021.” Drivers should take a number of measures in order to prevent pedestrian accidents.

  • Drivers should slow down at intersections.
  • Drivers should use their traffic signals to let others know of their intentions.
  • Drivers should check their blind spots before making turns.

All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Several steps should be taken after any pedestrian accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be sought.
  • Traffic camera footage should be sought.
  • An experienced pedestrian accident attorney should be contacted.

Depending on the facts of any case, liability for a pedestrian accident could extend beyond any driver. For example, the company that owned or operated a truck could potentially be liable. Many trucks are used for commercial purposes. It is best to seek the guidance of a skilled attorney after any accident. An attorney can examine the unique facts of your case and let you know what your legal options are.
