Liability For Westchester County Pedestrian Collisions

Most pedestrian accidents are avoidable when drivers are following traffic regulations. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When a driver fails to slow down to avoid hitting pedestrians, this could form the basis of a negligence claim. It is important that certain steps are taken after any car accident.

  • A police report of the incident should be created.
  • Eyewitnesses should be interviewed.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

It can be hard to know where to begin after any pedestrian accident. Victims of pedestrian accidents tend to suffer very serious and costly injuries. It is also common for accident victims to have lengthy recovery periods that require them to take off work. Any person who is injured in a pedestrian accident may be able to seek some measure of justice through a civil claim. A pedestrian accident attorney can examine the unique facts of your case and let you know what your legal options are.
