Liability In Westmoreland Pedestrian Accidents

Thousands of pedestrians are seriously injured or killed in pedestrian accidents every year. According to the Centers for Disease Control, an estimated 137,000 pedestrians were treated in emergency departments for crash related injuries. Nearly a third of fatal pedestrian accidents involve an intoxicated driver. There are many other factors that could potentially contribute to a pedestrian collision including:

  • Speeding
  • Driver distraction
  • Inclement weather
  • Driver fatigue
  • Heavy Traffic

Drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle & Traffic Law § 1146(a),  all drivers must take measures to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. Many collisions are due to drivers that are speeding. There are a number of steps that should be taken after any pedestrian accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a car accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
