Liability for Brooklyn Car Accidents
Car accidents remain one of the leading causes of serious injury and death in the United States. According to the IIHS, “There were 42,514 deaths from motor vehicle crashes in the United States in 2022. This corresponds to 12.8 deaths per 100,000 people and 1.33 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 4.8 in the District of Columbia and Rhode Island to 23.9 in Mississippi.” There are a number of common causes of car accidents.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
Depending on the facts of any case, a city could face liability for a collision if it was caused by a dangerous condition on public property. For example, a roadway may have lacked a guardrail that allowed a vehicle to crash into a fixed object at a high rate of speed. It is important that evidence is properly preserved after any collision.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
It can be difficult to know where to begin after a car accident. Victims are often left with serious injuries that can impact their ability to be gainfully employed. Many victims do not survive. The family of any person who died in a car accident may have legal recourse through a civil claim.
