Liability In Brooklyn Car Accidents
Thousands of people are killed or seriously injured every year in car accidents. According to the Centers for Disease Control, nearly 32,000 people die each year in car accidents in the United States. Another 2,000,000 were injured and needed medical treatment. Nearly 1 out of 3 fatal collisions involved a drunk driver. There are many other factors that could potentially contribute to a car accident.
- Distracted driving
- Inclement weather
- Driver fatigue
- Road conditions
A large portion of car accidents are due to drivers that are speeding. Pursuant to New York Vehicle Code 1180, no person shall drive a motor vehicle at a speed than would be safe given the prevailing conditions of the roadway. If a driver rear-ends another vehicle while speeding, they will nearly always be held at fault. Victims of car accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Spinal cord injuries
Any person that is injured due to the negligent actions of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A New York City car accident attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims. Failing to act within the statute of limitations may result in a permanent forfeiture of your rights.
