Liability for Long Island Sound Boat Crashes

New York law poses a number of duties on people who are operating vessels in waterways. In particular, New York Navigation Law § 45 requires that all vessels must be navigated carefully and with the prudence necessary to avoid causing harm to other people that are sharing the water. Among other things, boat operators must maintain a safe speed and keep a proper lookout. Courts will take into consideration numerous factors when evaluating who could be liable for a boat accident.

  • The speed of all vessels involved will be taken into consideration.
  • It is also important to determine whether the boat operators were maintaining a lookout or if they may have been distracted.
  • The owner of the boat will also be considered. Boat owners can be legally responsible for people they lawfully lend their vessel to.
  • Another important item is whether or not the boat operators involved had the proper license and safety certifications.

If a boat operator does not slow down to avoid colliding with another vessel, they could be held legally responsible for any resulting injuries. There may be several liable parties for any specific boat collision. This includes the owner of the boat or even a company that loaned the boat operator the vessel that they used. Boat rental companies could be liable for an accident under the legal theory of negligent entrustment.
