Liability In Manhattan Subway Train Accidents

Train accidents lead to an average of 600 deaths and 2,300 injuries every year in the US. The vast majority of these accidents are totally preventable. MTA workers are particularly at risk because they are often forced to work in close proximity to subway trains. There are a number of potential causes of subway train accidents.

  • Speeding trains
  • Cracks in the walkway
  • Slippery surfaces

When a worker is injured on the job they will typically be entitled to workers compensation. Workers compensation is a no-fault system that can help workers who get injured on the job. There could also be numerous sources of liability for a subway accident. According to  New York Labor Law 200, employers must maintain their premises in a reasonably safe condition. Failure to do this could create liability for an accident. There are numerous steps that should be taken after any subway accident.

  • Injured workers should seek medical care.
  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • A subway accident attorney should be consulted.

Any worker that is injured in a subway train accident may be able to seek damages through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. Sadly, though, the MTA often fights hard to deny liability for any subway accident. A New York City personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
