Liability for Trenton Wrong-Way Accidents
New Jersey law requires that all drivers maintain their vehicle on the right half of the roadway under N.J.S.A. 39:4-82. Drivers must also operate their vehicle at a speed that would be reasonably safe given the prevailing road conditions. It is also illegal for any driver to operate their vehicle under the influence of any alcohol or other substance. It is important that several steps are taken after any motor vehicle collision in New Jersey.
- Police Report: The police should be called to the scene as early as possible so that they can begin investigating.
- Medical Treatment: The victim should seek medical treatment as early as possible. Many of the injuries associated with a crash may not be immediately obvious.
- Surveillance Footage: Surveillance footage that may have captured the collision should be secured before it is recorded over.
- Legal Options: Victims should consider their legal options with a team experienced in personal injury claims.
Wrong-way collisions are often substantially more dangerous than other types of crashes. According to the AAA Foundation for Traffic Safety, about 500 people are killed every year in accidents involving wrong-way drivers. Many of these incidents involve drivers that were intoxicated by drugs or alcohol. The family of any person killed in a wrong-way collision is able to seek some measure of accountability through a wrongful death claim.
