Worker, 56, Dies After a Water Main Break Floods an Underground Work Area at Roosevelt Field
EAST GARDEN CITY, NEW YORK (October 31, 2026) – A 56-year-old construction worker was killed in an accident outside of Roosevelt Field in East Garden City.
Officials are saying that the incident occurred around 11:13 AM on Friday. The construction worker was in some type of underground area near Ring Road when a water main broke and submerged him.
EMS and rescue workers were called to the scene of the accident as quickly as possible. The worker was eventually extricated from the location and life-saving measures were administered to him before he was transported to a local hospital.
Unfortunately, he was beyond medical aid and later pronounced deceased by a physician. A full investigation by OSHA remains ongoing.
Liability for East Garden City Construction Accidents
New York’s Labor Law § 241(6) requires owners and contractors to maintain their premises in a reasonably safe condition that provides for the safety of workers and adheres to industrial codes. This is a nondelegable duty, so owners are not able to evade legal responsibility even if it was not work that they personally supervised. There are several potential sources of liability for any accident involving a water main break.
- Valve Shutoff: Before any crew is scheduled to work near a water main, all the valves should be identified and shut down.
- Emergency Egress: There should be an emergency egress system for workers in the event of a catastrophic incident.
- Competent Oversight: A competent person should oversee and inspect the operation of any work near a water main.
- Shared Responsibility: Property owners should hire contractors and share responsibility for safety at the site.
When a worker is injured in any type of water main break, property owners and general contractors could potentially be liable for resulting injuries. Consider, for example, Morton v. State of New York. That case involved a water company worker who was injured when the side of a trench dug to repair a broken water main collapsed. This case highlights the importance of cave-in protections and other safety systems when workers are confined in vulnerable locations.
