Jared Richardson Killed In Brooklyn Falling Tree Branch Accident at Reginald Salgado Playground

BROOKLYN, NEW YORK (August 16, 2022) – A 35-year-old man identified as Jared Richardson was killed in a Brooklyn accident at Reginald Salgado Playground after being hit by a falling tree branch.

New York City police officials are saying that the accident took place around 8:00 a.m. on August 13. Jared Richardson was sitting on a park bench inside Reginald Salgado Playground when he was struck in the head by a falling tree branch.

Paramedics were called to the scene in order to help the victim. Jared Richardson was taken to Kings County Hospital in critical condition but later died due to his injuries.

The branch was around 40 feet above the victim before it fell. City officials claim that the branch was in good condition when it was last inspected in August 2020.

Liability In Brooklyn Falling Tree Branch Accidents

Accidents involving people being hit by falling trees or falling tree branches may seem like freak occurrences, but they are far more common than many people realize. In fact, it has been estimated that nearly 100 people are killed every year in accidents involving falling trees or tree branches. There are a number of factors that could potentially contribute to a tree branch unexpectedly falling and striking someone.

  • Tree branches may fall off due to some underlying disease with the tree.
  • Tree branches may fall off as a tree ages and becomes more fragile.
  • Tree branches may fall off due to prior structural damage.

Depending on the facts of any case, a property owner could be liable for someone that is hit by a falling tree branch. A property owner could be a private person, a corporation or a municipality like New York City. All property owners have a legal obligation to maintain their premises in a reasonably safe condition. This must be done for the protection of all persons on a property whose presence is reasonably foreseeable.

Adequately maintaining a property includes periodically inspecting the trees that are on it. Tree branches do not just fall totally at random. Accidents are often preceded by decay, disease and neglect. When a property owner is aware of a potentially dangerous tree on their property, they must take measures to correct the dangerous condition. Failing to correct the dangerous condition with the tree could form the basis of a negligence claim. There are a number of steps that should be taken after any accident involving a falling tree branch.

  • The tree involved in the accident should be inspected.
  • Maintenance records of the tree should be examined.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

The family of any person that is killed in an accident with a falling tree may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Unfortunately, municipal entities will fight hard to deny liability for any accident involving a tree on their property. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
