Liability for Bronx Hit-and-Run Collisions
Thousands of people are killed or seriously injured every year in hit-and-run collisions. According to the AAA Foundation for Traffic Safety, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” A number of different factors could contribute to a hit-and-run collision.
- Distracted driving
- Inclement weather
- Poor road conditions
- Driver fatigue
All scooter operators have a legal obligation to operate their vehicle at a reasonably safe speed. They are also not permitted to ride on the sidewalk. If a scooter rider fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Several steps should be taken after any hit-and-run collision.
- Fragments of the fleeing vehicle should be sought.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
Scooter accidents can often leave victims with very serious injuries. This is particularly true when someone sustains a head injury. Traumatic head injuries often require that victims get extensive medical treatments. Victims are also at a greater risk of developing many different neurodegenerative injuries. Any person injured in a scooter accident may be able to seek some measure of justice through a civil claim.
