New York City officials are saying that the accident took place around 8:15 AM on Friday. For undetermined reasons, the 13-year-old boy was injured by the subway.
Authorities suspect that he may have been subway surfing when the accident took place. Paramedics were called to the scene in order to help the victim.
He was taken to the hospital in order to receive treatment. A full investigation into the Queens subway accident remains ongoing at this time.
Liability for New York City Subway Accidents
Many people are injured in subway accidents every year. According to one study in the National Institutes of Health, “There were 668 subway-related fatalities, of these, 10 (1.5%) were homicides, 343 (51.3%) were determined to be suicides, and 315 (47.2%) were accidental. Although decedent characteristics varied between fatality categories, they were not particularly informative with regard to prevention.” The MTA should take a number of actions in order to prevent subway accidents.
- The MTA should install platform screen doors in certain locations in order to prevent people from accidentally falling on the tracks.
- The MTA should implement automated train control systems in order to reduce the possibility that someone is injured through human error.
- The MTA should use nonslip surfaces in order to prevent people from accidentally falling.
Depending on the facts of any case, the MTA could be liable if someone is injured in a subway train accident. In fact, the MTA, TikTok, and Meta are facing a lawsuit after the death of a 15-year-old boy in Manhattan who tragically died in a subway surfing incident. Attorneys for the plaintiff argued that the social media platforms kept feeding the victim videos of subway surfing. The MTA also allegedly failed to lock subway doors, which allowed the teen boy to climb on top of the subway train. It is important that certain steps are taken after any subway accident.
- Medical records related to the incident should be preserved.
- A police report should be created.
- The circumstances leading up to the incident should be investigated.
- The subway involved in the incident should be examined.
It can be hard to know where to begin after any subway accident. Victims are often left with life-changing injuries. Many people contend with high medical bills. The trauma of a subway accident can be exponentially worse when a person loses a loved one. It is important for victims of subway accidents to understand that they do have legal rights. They are able to seek some measure of accountability through a wrongful death claim.
