Liability For New York City Hit-And-Run Collisions
Thousands of people are killed or seriously injured in hit-and-run collisions every year in the United States. According to the AAA Foundation for Traffic Safety, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” There are several steps that should be taken after any hit-and-run collision.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- An experienced personal injury attorney should be contacted.
All drivers have a legal obligation to slow down in order to avoid hitting pedestrians and cyclists on the road. The vast majority of bicycle accidents are preventable and involve some amount of driver error. This could include instances when drivers are traveling too fast for the prevailing conditions. There is a rebuttable presumption of negligence on the part of any driver who rear-ends a vehicle or bicyclist in their own lane of travel. Victims of bicycle accidents tend to suffer very serious and costly injuries, including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
Car accidents can be extremely difficult to go through. Many accident victims may not realize the full extent of their injuries for several weeks or months after a crash. When a person is involved in a collision, they will be filled with adrenaline, which can mask pain. Any person who is injured in a bicycle accident may be able to seek some measure of justice through a civil claim. A bicycle accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
