Liability In Staten Island Bus Accidents

Thousands of people are killed or seriously injured in bus accidents every year. According to Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” There are a number of factors that make buses particularly dangerous.

  • Buses are difficult to control and are much more difficult to stop than passenger vehicles.
  • Buses have large blind spots that can obscure the presence of other vehicles.
  • Bus drivers often work long hours and can easily become fatigued.

Bus driver’s must get a commercial drivers license (CDL) and are held to a high standard in terms of safety. There is no reason that a bus should ever rear-end another vehicle. In fact, there is a rebuttable presumption of negligence for any driver that rear-ends another vehicle. Most rear-end collisions are due to drivers that are distracted, speeding, or following the lead vehicle too closely. When a bus driver is negligent, the company that they work for could be held vicariously liable. Victims of bus accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Spinal cord injuries

The FMCSA requires commercial buses that can carry 16 or more passengers to have at least $5,000,000 worth of liability coverage. Any person that is injured in a bus accident may be able to seek aid through a bodily injury claim. Damages in a civil claim can help with lost wages, medical bills and pain and suffering. A New York City bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
