Liability for New York City Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured every year across New York. According to the New York Department of Health, “Injuries to pedestrians are among the top 10 leading causes of injury-related hospital admissions and death for almost all age groups In New York State. Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” Drivers should take a number of different actions in order to prevent pedestrian collisions.
- Drivers should continuously scan the road ahead of them for hazards.
- Drivers should use their horns to alert pedestrians of their presence in certain situations.
- Drivers should check their blind spots before making turns at intersections.
All drivers must use caution in order to avoid hitting pedestrians in the roadway. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Several factors may contribute to a pedestrian accident.
- Pedestrian accidents are much more likely to occur when drivers are speeding.
- A large portion of pedestrian accidents involve a driver who is intoxicated.
- Pedestrian accidents are likely to occur at night when visibility is reduced.
Pedestrian accidents are often highly preventable. They tend to involve drivers who are not taking into consideration how long it would take to stop if the pedestrian is in front of their vehicle. Sadly, though, drivers will often do everything in their power to deny liability in the event that they hit someone. This is why it is so important that accident victims consult with an experienced personal injury attorney.
