Liability For Staten Island Garbage Truck Accidents
Garbage trucks can be very dangerous and are involved in many serious collisions every year. According to one report from the Federal Motor Carrier Safety Administration (FMCSA), there are around 2,500 garbage truck fatalities every year. Garbage trucks have large blind spots that can obscure the presence of pedestrians. A fully loaded garbage truck can weigh as much as 50,000 lbs. Truck drivers should take a number of measures in order to avoid collisions.
- Truck drivers should check their blind spots before making turns.
- Truck drivers should ensure their vehicles are well maintained.
- Truck drivers should slow down in areas with heavy traffic.
All drivers must operate their vehicles with caution and take steps in order to avoid collisions. Pursuant to New York Vehicle & Traffic Law § 1180, no person is allowed to operate a motor vehicle faster than what would be prudent or safe given the prevailing conditions of the roadway. It is common for accident victims to suffer very serious and costly injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
Depending on the facts of any case, there could be numerous sources of liability for any garbage truck accident. If a truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Any person injured in a garbage truck accident may have legal recourse through a civil claim.
