Liability for Long Island Pedestrian Accidents
Pedestrians lack the protection of enclosed vehicles and are much more likely to be killed or seriously injured in the event of a crash. According to the IIHS, “A total of 7,522 pedestrian deaths occurred in 2022. Pedestrian fatalities account for 18% of all crash fatalities. Although pedestrian deaths in 2022 were approximately the same as in 1975, they have increased 83% since reaching their lowest point in 2009.” Drivers should take a number of measures in order to avoid hitting pedestrians.
- Drivers should check their blind spots at intersections.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should abstain from alcohol and other intoxicating substances.
Drivers have a legal obligation to exercise due care in order to avoid collisions. This requires that they constantly scan the road ahead of them and take evasive action to avoid hazards. If a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Pedestrian accidents often result in very serious injuries.
- Head injuries
- Amputations
- Lacerations
- Spine injuries
Pedestrian accidents are often highly preventable. They tend to be the result of drivers that are traveling too fast for the prevailing conditions. It is important that accident victims take certain steps in order to preserve their health and legal rights after a collision. After they receive a thorough medical evaluation, they should seek the guidance of an experienced personal injury attorney. An attorney can examine all of the unique facts of your case and let you know what your legal options are.
