LONG ISLAND, NEW YORK (January 10, 2025) – At least six people were injured after a dump truck collided with an SUV and school bus in Old Westbury.
Long Island officials are saying that the accident took place around 3:30 p.m. on Tuesday. A dump truck was traveling down Post Road and went through an intersection before colliding with a school bus and SUV.
Firefighters and paramedics were called to the scene in order to help all of the victims. Two children and four adults were injured in the crash.
There are reports that the dump truck may have lost its brakes before going through a red light. A full investigation into the Old Westbury school bus accident remains ongoing at this time.
Liability for Long Island Dump Truck Accidents
Dump trucks can be particularly dangerous, especially for pedestrians and those in smaller vehicles. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” Dump truck companies should take a number of measures in order to avoid collisions.
- Dump truck companies should ensure that all of their drivers have a clean record and commercial license.
- Dump truck companies should ensure that all of their vehicles are properly maintained.
- Dump truck companies should consider installing safety features like automatic collision avoidance systems.
The company that owned or operated a dump truck could potentially be liable for any collision involving their driver. Pursuant to New York Vehicle Code 1111, the driver of any vehicle approaching a red light must stop at the intersection and only proceed when it is safe to do so. There is a rebuttable presumption of negligence if a dump truck driver goes past a red light without stopping prior to a collision. Several steps should be taken after any dump truck collision.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
The vast majority of dump truck collisions are preventable. They often involve situations where dump truck companies fail to properly maintain their vehicles. Maintenance can be expensive, and it is common for companies to neglect routine maintenance in order to save money. This could explain why the brakes on any vehicle went out. Any person injured in a dump truck collision may have legal recourse through a civil claim.
