New York Supreme Court, Index # 158080/2018, Hon. Judy H. Kim. Settled on November 3, 2023
Gersowitz Libo & Korek, P.C. secured a seven-figure ($5,000,000) confidential settlement against the City of New York and a private trucking company for a 27-year old bicyclist who was struck and run over in New York City. Tragically, the bicyclist underwent several surgeries to repair her foot before having it amputated. The defendants attempted to claim they were not responsible because the bicyclist was not in a designated bicycle lane at the time she was runover. However, discovery obtained by Gersowitz Libo & Korek, P.C. showed that the City of New York improperly designed the bicycle lane and did not provide sufficient warning signs for bicyclists and motorists. The case was handled by partner Jeff S. Korek and senior associate Daniel B. Linson.
