Liability For Rochester Car Accidents

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020.1 That’s about one death every 75 minutes. One in six people who died in crashes in 2020 were pedestrians.” There are a number of factors that could contribute to a pedestrian accident.

  • Speeding
  • Drunk driving
  • Inclement weather
  • Driver distraction

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. If a driver fails to reduce their speed to avoid hitting a pedestrian, This could form the basis of a negligence claim. The family of any person that is killed in a pedestrian accident may have legal recourse through a wrongful death claim. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
