Liability for Long Island School Bus Accidents
School buses can be particularly dangerous for pedestrians and people in passenger vehicles. According to the National Safety Council, “School bus-related crashes killed 128 people nationwide in 2023, up 23% compared to the 104 deaths in 2022, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” School buses can contribute to accidents for several reasons.
- School buses have large blind spots that may obscure the presence of pedestrians.
- School buses weigh tens of thousands of pounds and are difficult to bring to a safe stop.
- School buses have a wide turning radius, which can increase the likelihood of side impact collisions.
School buses are considered common carriers. Their drivers must operate with a great deal of caution to avoid collisions. This requires that they continuously scan the road ahead of them and travel at a safe speed. If a school bus driver fails to slow down to avoid colliding with a pedestrian, this could form the basis of a negligence claim. Victims of school bus accidents tend to suffer grave injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
When a school bus driver is negligent and causes an accident, their employer could be held at fault. In general, employers in New York can be vicariously liable for the wrongful actions of their workers who are operating within the course and scope of their job duties. The family of any person killed in a school bus collision can see some measure of accountability through a civil claim.
