Liability For Barton Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured in collisions every year. According to the Centers for Disease Control, “Nearly 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2021. That’s about one death every 66 minutes. One in six people who died in crashes in 2021 were pedestrians.” There are a number of factors that could contribute to pedestrian collisions.
- Inclement weather
- Poor road conditions
- Distracted driving
- Driver intoxication
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. This is true even if a pedestrian is idle in the middle of the road. If a driver fails to take steps in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. The family of any person who is killed in a pedestrian accident may have legal recourse through a civil claim.
