Liability for Sunset Park, Brooklyn Car Accidents

Pedestrian accidents remain a common cause of preventable injury and death in New York City and across the United States. According to the Centers for Disease Control, “Over 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2022. That’s about one death every 64 minutes.” Victims of pedestrian accidents tend to suffer very serious injuries.

Drivers must use caution to avoid colliding with pedestrians. They must be particularly cautious around pedestrians at intersections. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. The family of any person killed in an accident may be able to seek justice through a civil claim.
