Liability for Cherry Hill Nursing Home Abuse
Abuse at long-term care facilities is unfortunately far too common. According to the World Health Organization, “Abuse of older people is an important public health problem. A 2017 review of 52 studies in 28 countries from diverse regions estimated that over the past year 1 in 6 people (15.7%) aged 60 years and older were subjected to some form of abuse.” Nursing homes should take a number of measures in order to prevent abuse.
- Nursing homes should ensure that all employees undergo a thorough background check.
- Nursing homes should closely monitor all patients.
- Nursing homes should understand the factors that contribute to victimization and predation.
Nursing homes have a legal obligation to protect all residents and guests from reasonably foreseeable sources of harm. This includes protecting them from violence at the hands of workers. When a nursing home has actual or constructive notice that a worker poses a risk to residents, they must take action. It is important that certain steps are taken after any instance of abuse in a nursing home setting.
- A police report should be created.
- Medical records related to the abuse should be preserved.
- The history of incidents involving the worker should be reviewed.
- An experienced nursing home abuse attorney should be contacted.
It can be hard to know where to begin after any instance of nursing home abuse. Abuse in this setting is a deep betrayal of trust. It is common for victims of nursing home abuse to sustain lasting and serious injuries. Any person that is injured in a nursing home setting may be able to seek some measure of justice through a civil claim. A nursing home abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
