Liability for Queens Car Accidents
Speeding is one of the primary causes of fatal collisions in the United States. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2022, killing 12,151, or an average of over 33 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,922.” Speeding can affect a driver’s ability to operate their vehicle safely in a number of ways.
- Speeding can dramatically increase a vehicle’s stopping distance.
- Drivers are more likely to lose control of their vehicle at higher speeds.
- Drivers are less able to notice hazards in the roadway at higher speeds.
Every driver must use caution in order to avoid collisions. Drivers must stop at red lights and yield signs and wait until it is safe to proceed. There is a rebuttable presumption of negligence on the part of any driver that goes past a yield sign without stopping. Victims of car accidents tend to suffer very serious injuries.
- Broken bones
- Had trauma
- Organ damage
- Amputations
The vast majority of car accidents are completely preventable. They tend to involve drivers that are speeding, distracted, or intoxicated. Depending on the facts of any case, there could be numerous sources of liability for a collision. There are several laws in New York that protect families in the event that their loved one dies in a collision. Among other things, family members are able to pursue some measure of accountability for the death of their loved one through a wrongful death claim.
