Liability For New York City Car Accidents

Speeding remains one of the leading causes of car accidents in the United States. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2022, killing 12,151, or an average of over 33 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,922.” Several other factors could contribute to a car accident.

  • A car accident may take place due to distracted driving.
  • A car accident may take place due to unsafe road conditions.
  • A car accident may take place due to driver intoxication.

All drivers have a legal obligation to exercise due care in order to avoid collisions. If a driver fails to slow down in order to avoid hitting another vehicle, this could form the basis of a negligence claim. It is crucial that evidence is properly preserved after any car accident.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • Eyewitnesses should be interviewed.

Most car accidents are preventable. In fact, it is estimated that 93% of all collisions involve some amount of driver error. It is important for accident victims to understand that they do have rights. The family of any person who died in a collision may be able to seek some measure of accountability through a civil claim.
