New York Lymphedema Attorneys

medical malpractice attorneyLymphedema refers to the swelling of the arms or the legs that occurs when vessels in the lymphatic system are blocked, preventing the draining of lymph fluid. When this medical condition is caused by a surgical or medical procedural, the patient may be entitled to monetary compensation if the medical team acted in a negligent or reckless manner.

If you or someone you know is suffering from lymphedema that was caused by a surgical or medical procedure that was conducted by healthcare professionals whose actions fell below the accepted standard of practice in the medical community, call the experienced lymphedema lawsuit attorneys at Gersowitz, Libo & Korek, P.C.

What Is Lymphedema?

Lymphedema is a chronic condition that often results from accidents, injuries and surgical procedures that cause some type of damage to the lymph system. This condition can also be the byproduct or from other medical conditions such as cancer and repeated parasitic or bacterial infections.

When the lymph vessels are compromised, regardless of what initial act caused it, it can result in swelling in the arms and/or legs. In more severe cases, lymphedema can make it extremely difficult and painful for the individual to use the affected limb. In some cases, it may also lead to the total immobilization of the limb altogether.

Symptoms and Treatments of Lymphedema

Lymphedema may result in the following symptoms:

  • The affected limb feeling heavy
  • An increasing feeling of fatigue
  • The skin feeling extremely tight, or even tearing and causing skin ulcerations
  • A weakening of the immune system, leading to the development of bacterial, viral or other infections that generally occur due to a compromised lymph system function
  • Decreased flexibility in the affected limb(s)

Treatments of lymphedema may vary depending on how severe the condition is and what caused it. Common treatments generally include:

  • Use of compression garments, such as support pantyhose and sleeves
  • Elevating the affected limb(s)
  • Specific exercises that are targeted to the affected limb(s)
  • Adjustments to the individual’s diet, including a reduction in sodium intake
  • A variety of skin care regimens

Filing a Personal Injury Lawsuit

While the majority individuals who suffer from lymphedema generally seek compensation by filing for Social Security Disability, in certain situations these individuals may also be able to file a personal injury lawsuit as well.

One of the causes of lymphedema is a surgical procedure that damages the lymph vessels or a botched surgical removal of lymph nodes. In such situations where the negligent or reckless actions of healthcare professionals ultimately resulted in the patient suffering lymphedema, the patient may be able to file a lymphedema medical malpractice lawsuit.
