Liability for Staten Island School Bus Accidents
School buses are typically very safe, but they can be particularly dangerous for pedestrians and those in smaller vehicles. According to the National Safety Council, “School bus-related crashes killed 104 people nationwide in 2022, down 3.7% compared to the 108 deaths in 2021, according to National Safety Council (NSC) tabulations of data from the National Highway Traffic Safety Administration (NHTSA).” There are a number of reasons that school buses can be dangerous.
- School buses have large blind spots that can obscure the presence of pedestrians.
- School buses weigh substantially more than passenger vehicles and can be dangerous at much lower speeds.
- School buses have a high center of gravity, which can lead to pedestrians being pulled underneath.
Bus drivers have a legal obligation to operate with a great deal of caution in order to avoid collisions. They must use slow down to avoid hitting pedestrians, even if they are outside of a marked crosswalk. If a school bus driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of school bus accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The vast majority of school bus collisions are preventable. They tend to involve bus drivers who are making unsafe turns or are speeding. Sadly, though, bus drivers and their employers will often do everything in their power to deny responsibility for a fatal collision. The family of any person who died in a school bus accident may have legal recourse through a civil claim.
