Liability for Bronx Car Accidents
Thousands of people are killed or seriously injured every year in collisions across New York City. Many of these accidents involve people on bicycles or smaller motorized vehicles. According to People For Bikes, “New York City had 47% of nationwide e-bike fatalities even though its residents only account for about 2.5% of the U.S. population.” There are a number of steps that drivers should take in order to avoid hitting people on bicycles or smaller vehicles like dirt bikes.
- Drivers should check their blind spots before making turns.
- Drivers should use their horn to alert people of their presence.
- Drivers should maintain a safe distance with vehicles ahead of them.
All drivers have a legal obligation to exercise due care in order to avoid collisions. They must be particularly cautious around pedestrians, bicycles, e-bikes, and smaller vehicles. If a driver fails to slow down to avoid hitting another person, this could form the basis of a negligence claim. It is important that evidence is properly preserved after any accident.
- Surveillance footage of the collision should be sought.
- Medical records related to the crash should be preserved.
- The police report for the accident should be collected.
The vast majority of car accidents are preventable. They tend to involve drivers that are not adequately scanning the road ahead of them. Accidents are much more likely to happen during the early morning and late evening when visibility is reduced. It is important that victims understand that they do have legal rights. They are able to seek some measure of accountability through a civil claim.
