Liability for East Village MTA Bus Accidents
Many people are seriously injured every year in bus accidents. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” Bus drivers should take several measures to avoid collisions.
- Bus drivers should continuously scan the road ahead of them for pedestrians and other hazards.
- Bus drivers should slow down in areas with dense traffic.
- Bus drivers should check their blind spots before making turns at intersections.
Bus drivers are considered common carriers. They must operate with an abundance of caution to avoid causing harm to their passengers or pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. Any driver intending to turn left must first yield the right-of-way to any cyclist that is close enough to pose a hazard. When a driver fails to slow down to avoid colliding with any pedestrian in the roadway, this may be construed as negligence. It is important that victims of bus accidents take certain measures to protect their rights.
- Victims should seek a thorough medical evaluation.
- Victims should seek the contact information of eyewitnesses.
- Victims should take as many pictures of the accident site as they can.
- Victims should seek the guidance of an experienced New York bus accident attorney.
Bus accidents are often highly preventable. They tend to involve situations where bus drivers are not properly scanning the road ahead of them. It is important for victims of bus accidents to understand that they do have legal options. They are able to seek some measure of accountability through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
