Liability for Bronx Window Fall Accidents
Falls remain one of the leading causes of serious injury and death for young children. According to Stanford Medicine, “It is estimated that more than 2.2 million children ages 14 and under are treated annually at hospital emergency rooms for fall-related injuries. Reports show falls kill about 100 children ages 14 and under every year. More than half of fall-related injuries among children occur among ages 4 and under.” There are a number of areas that present fall risks for children.
- Playgrounds
- Furniture
- Windows
- Bicycles
Depending on the facts of any case, the owner of an apartment could be liable if a child is injured or killed in an apartment fall. Apartment owners have a legal obligation to ensure that their premises are in a reasonably safe condition. If they have active or constructive notice of a dangerous condition with their property and fail to act, this could form the basis of a negligence claim. There are a number of ways that an apartment owner may have failed to prevent a child from falling out a window.
- Apartment owners may have failed to install window guards or stops.
- Apartment owners may have allowed a window to remain in disrepair.
- Apartment owners may have failed to properly secure air conditioners.
The vast majority of window fall accidents are highly preventable. They tend to involve situations where apartment owners fail to adhere to building code regulations. For example, apartments with young children will typically need safety guards on the windows. The family of any child who died in a window fall may have legal recourse through a civil claim.
