Liability for Bronx Window Fall AccidentsÂ
Property owners in New York City must take reasonable measures to protect their tenants from foreseeable sources of harm. New York City has specific safety requirements related to windows. Under New York City Health Code § 131.15, a person who controls a multiple dwelling building must install and maintain compliant window guards in any unit where a child 10 or younger resides. It is important that certain actions are taken after any accidents involving a child who fell from the window.
- It should be determined if the unit in question had functional window guards.
- It should be determined if there is a history of similar accidents at the property in question.
- All medical records related to injuries should be collected and preserved.
- The family of any child injured in a window fall should consider their legal options with our team, experienced in personal injury and premises liability claims.
When a property owner has actual or constructive notice that their building is in an unsafe condition, they must take action. This also applies to window guards. Property owners must install window guards for all units where young children live. The family of any child injured in a window fall accident may be able to seek some measure of justice through a personal injury claim. Damages in a civil claim could help cover lost wages, medical bills, and pain and suffering.
