Ms. Fiero, a 36 year-old hairdresser was injured when she fell into an open subway vent in the sidewalk in Brooklyn. Ms. Fiero retained GLK, who then commenced an action against the City of New York, the Metropolitan Transportation Authority (MTA), and the New York City Transit Authority (NYCTA), as well as the adjoining corporate landowner Son Claire Realty LLC.

All defendants filed motions claiming Ms. Fiero’s case against them should be dismissed. The trial court dismissed the case against the City of New York and kept the MTA, NYCTA, and Son Claire Realty LLC in the action.

cydney korekThe NYCTA attempted to overturn the trial court’s decision by appealing the decision to the Appellate Division, Second Department. Following the submission of papers and oral argument, GLK was successful in persuading the Appellate Division to keep the NYCTA in the lawsuit.

Cyd a former prosecutor with the Brooklyn District Attorney’s office will be speaking to an audience of practicing attorneys on each parties’ arguments, the trial court’s decision, and the favorable decision of the Appellate Division, Second Department, in this very significant case that is a win for all New Yorkers.
