Liability For Brooklyn DUI Car Accidents

Drunk driving remains one of the leading causes of car accidents in the United States. According to the NHTSA, “Every day, about 37 people in the United States die in drunk-driving crashes — that’s one person every 39 minutes. In 2022, 13,524 people died in alcohol-impaired driving traffic deaths.” Even small amounts of alcohol can substantially impair a person’s ability to operate their vehicle safely.

  • Drivers are less able to stay within one lane of traffic.
  • Drivers are less able to slow for vehicles ahead of them.
  • Drivers are more likely to lose control of their vehicles.

It is illegal for any person in New York to operate a motor vehicle with a blood alcohol concentration of 0.08% or higher. Commercial drivers are held to an even higher standard. They cannot operate a motor vehicle with a blood alcohol concentration of 0.04% or higher. There is a rebuttable presumption of negligence on the part of any driver who hits another vehicle after going past a yield sign without yielding. Several steps should be taken after any DUI collision.

  • Eyewitnesses should be interviewed.
  • Medical records related to the crash should be sought.
  • Traffic footage should be examined.
  • An experienced personal injury attorney should be contacted.

It can be hard to know where to begin after any car accident. Victims are often left with high medical bills and life-altering injuries. Sadly, drivers and their insurance providers will often do everything that they can to deny liability for a collision. This is why it is always a good idea to seek the guidance of an experienced personal injury attorney. An attorney can examine the unique facts of your case free of charge and let you know what your legal options are.
