Malpractice / Birth Injury

Medical Malpractice/ Foreign Body
A jury returned a verdict in the amount of $3 million in Bronx County on behalf of a 52 year old married father of two. During a radical prostatectomy, the doctor and surgical team assisting in the procedure failed to ensure that all of the surgical tools used during surgery were accounted for. As a result, they left a piece of umbilical tape inside our client’s body at the end of the procedure. Our client suffered urinary problems as a result and was forced to wear adult diapers for a period of time. Our client also underwent 16 separate procedures to correct the mistake, one of which included the permanent placement of an artificial sphincter.
Medical Malpractice / Failure to Timely Perform Surgery
A settlement in the amount of $2.4 million was reached in Bronx County on behalf of the Estate of a 50 year old father of three.Our client went into the hospital after experiencing complications from an untreated gall bladder infection. During our client’s admission to the hospital, doctors failed to timely perform surgery and failed to timely institute antibiotic coverage. This delay in treatment caused our client to develop pneumonia and Acute Respiratory Distress Syndrome which subsequently resulted in his death.

Doctors failed to properly perform a myomectomy and punctured her uterus and colon during surgery. Subsequently, our client was forced to undergo restorative surgery to repair the perforations.

A $500,000 settlement was won on behalf of a 70 year-old physician whom doctors failed to properly diagnose with an infection and a recurring hip dislocation resulting in the permanent deformation of his right hip; a permanent limp due to the one-inch shortening of his right leg; right hip trochanteric osteosynthesis and the removal of the heterotopic bone.

A $500,000 settlement was won on behalf of a 28 year-old group manager of a travel agency. While undergoing gall bladder surgery, the group manager developed sepsis and a bile leak necessitating further surgeries.
MOTOR VEHICLE / COMMERCIAL VEHICLE
Motor Vehicle/ Sanitation Truck
A settlement during trial was reached in the amount of $9.5 million in Queens County on behalf of a 23 year old real estate project manager and father who was struck by a sanitation truck while riding his motorcycle. Our client was required to undergo an above the knee amputation, also known as left hip disarticulation. He underwent 15 surgeries related to this incident.
Motor Vehicle/ Commercial Van
A settlement in the amount of $8 million was reached in New York County on behalf of a 46 year old legal assistant who was struck by a commercial van. The pedestrian suffered permanent brain injury and is confined to a wheelchair as a result of the incident.
Motor Vehicle/ Commercial Bus
A verdict in the amount of $5 million was reached in New York County on behalf of a 48 year old man who was a passenger in a motor vehicle which was rear-ended by a commercial bus. As a result of the accident, our client suffered mild traumatic brain injury.

A settlement in the amount of $2,250,000 was reached in New York County during mediation prior to trial on behalf of a 43 year-old man who was a passenger in a vehicle that lost control and struck a utility pole. The man had to have over 13 surgeries to repair a fractured elbow.

A settlement in the amount of $1.2 million was reached in Middlesex County, New Jersey on behalf of a 49 year old man who sustained injuries after his vehicle was struck by a commercial vehicle which made an illegal u-turn into his lane of travel. Our client suffered a right thigh bone fracture and a right hip fracture as a result of the accident. Our client underwent three surgeries related to these injuries.

A settlement in the amount of $1 million was reached in Bronx County on behalf of our client, a 55 year old woman whose foot was run over by a motor vehicle in a private parking lot. Our client sustained a crush injury to her foot, a lisfranc fracture and subsequent arthritis as a result of the accident.
Train Accident
A settlement during trial in the amount of $975,000 was reached in Queens County on behalf of a 55 year old man who was hit by a train as he attempted to disembark. Plaintiff suffered a below the knee amputation of his right leg as a result of the occurrence.
Motor Vehicle / Bystander Injury
A verdict in the amount of $700,000 was reached in New York County on behalf of out client, a 43-year old real estate agent who, while walking on his lunch break, was struck by a bumper that had flown off a car during a two car collision. As a result of being struck, our client suffered multiple fractures to his left foot including a lisfranc fracture and a fractured metatarsal. Our client was forced to undergo two surgeries to his foot and had a bone graft procedure performed.

A settlement in the amount of $650,000 was reached in Rockland County on behalf of a 58 year old computer executive who was struck by a snow plow which backed up into him. As a result of the incident, our client underwent surgery to replace a fractured humerus.
Motor Vehicle
A $625,000 settlement was won on behalf of a 23 year-old woman who was the victim of a two-car collision. Consequently, she required back surgery and suffers from severe back pain.

A settlement was reached in the amount of $585,000 in Kings County on behalf of an 11 year-old boy who was struck by a plumbing supply truck as he attempted to cross the street. The child suffered a fractured skull, a subdural hematoma and a fractured right tibia as a result of the accident.
NEGLIGENCE
Negligence / Elder care
A settlement in the amount of $750,000 was reached after a four week trial in New York County on behalf of the family of a 69 year old man who was a resident of a long term care facility. The man died as a result of exposure to the elements after he was improperly discharged to his own care and not returned to the long term care facility for a period of 12 days.
PREMISES LIABILITY
Improper Evacuation / Elevator
A settlement was reach after a 4 week trial in the amount of $8.5 million on behalf of a 41 year old business owner and father in New York County. During his stay at a new York City hotel, our client became trapped between floors in the hotel’s elevator. The staff encouraged improper evactuation procedures, causing our client to fall down an elevator shaft and suffer a large gash to his left groin. Our client required five surgeries and several hospitalizations and now suffers from permanenet scarring, lymphedema (chronic swelling of leg) and constant pain.
Trip and Fall (Sidewalk) / Medical Malpractice
A verdict of $3.4 million was won on behalf of a 58 year-old business man who tripped and fell on a sidewalk, causing a bimalleolar fracture/dislocation of his right ankle. He underwent an open internal fixation of his right ankle at New York University Medical Center. Upon discharge he developed a gangrene infection in his lower right extremity which ultimately required a below the knee amputation of his right leg. The verdict was achieved after four weeks of trial in New York County.
Poor Maintenance / Ferry
A settlement in the amount of $2.2 million was reached in Nassau County during mediation prior to trial on behalf of a 56 year-old woman. The woman was waiting in line at a concession stand on a ferry when she was struck by a heavy refrigerator that fell from a countertop. She suffered numerous injuries and had to undergo knee replacement surgery as a result of the incident.
Trip and Fall / Sidewalk
A settlement in the amount of $2.2 million was reached in New York County on behalf of a 60 year old secretary who was caused to trip and fall due to an unleveled sidewalk subway grate. As a result of the incident, our client suffered a fractured neck requiring two surgeries as well as a fractured elbow.
Defective Step/ Apartment Building
A settlement in the amount of $1.4 million was reached in Bronx County on behalf of a 35 year old student who fell in an apartment building stairwell due to a defective step. Our client suffered a severe knee injury and required multiple surgeries to repair and manage the pain.
Improper Building Mantenance
A settlement in the amount of $750,000 was reached in Kings County on behalf of a 29 year old woman who was attacked and robbed in the lobby of her building. The attacker was able to gain unlawful access to the building due to the building owner’s failure to provide and implement proper security measures.
Gas Explosion / Pedestrian
An arbitration award in the amount of $700,000 was reached on behalf of a 22 year old woman who was seriously injured as a result of a gas explosion. Our client was walking to work when she was hit by flying debris from the explosion. The woman underwent four surgical procedures to repair complex lacerations to her face and body. There was limited insurance coverage and many claims from other people who were injured as a result of the blast.
Faulty Construction/ Stairwell
An settlement in the amount of $515,000 was reached in Kings County on behalf of a 48 year old nurse and graduate student who slipped down a stairwell due to improperly constructed steps and handrails and lack of sufficient lighting. Our client suffered a sever fracture to her right shoulder which required four surgeries and has caused permanent scarring, pain and disability of shoulder.
WORKPLACE
Construction Accident / Bobcat Machine
A settlement was reached in the third week of trial in the amount of $7.5 million on behalf of the eight surviving children of a 38 year old construction worker. During the course of his employment, the construction worker was caused to fall off a Bobcat machine, rendering him a quadriplegic. Subsequently, the construction worker died as a result of complications from his injuries.
Construction Accident / Ironworker
A settlement in the amount of $2.5 million was reached in Bronx County on behalf of the estate of a 44 year old ironworker’s apprentice. The apprentice was performing work on the underside of a bridge when he was caused to fall to his death due to improper safety precautions at the work site, including improper scaffolding and fall protection.
Police Officer
A $1,569,000 verdict was won on behalf of a 30 year-old officer of the New York City Police Department who slipped and fell as a result of substandard flooding conditions in the precinct where he was newly assigned. The injuries effectively ended his career as a police officer. He tore the anterior cruciate ligament; the medial and lateral menisci, necessitating two surgeries.

An $838,000 settlement was won on behalf of a 39 year-old carpenter foreman who fell off of a scaffold, sustaining serious injuries, including a right wrist fracture, three fractured ribs, and a disc herniation at C3-4 which required surgery.

A settlement in the amount of $2.5 million was achieved in New York County on behalf of the family of a 42 year old woman who died after being exposed to Legionnaire’s Disease while seeking treatment at a hospital for an unrelated condition.

A settlement in the amount of $2,500,000 was reached in Kings County on behalf of the estate of a 38 year-old woman who was the victim of medical malpractice during childbirth. The hospital failed to properly perform a C-section and allowed the woman to become hypoxic. The woman died as a result of her injuries and left behind a husband and six children.
