A settlement of $6,750,000 was achieved for a pedestrian, struck by an MTA bus, who sustained severe orthopedic injuries. The pedestrian, who had no memory of the incident, was hit while crossing a busy street in the middle of the block and at night. While the case was pending, the driver of the bus passed away before he could provide any testimony. However, the bus’s dash camera footage, along with surveillance video from a nearby apartment building obtained by Gersowitz Libo & Korek, P.C. showed that the bus driver should have seen the pedestrian in time to avoid hitting her. The case was handled by partners Jeff S. Korek and Edward H. Gersowitz, and senior associate Daniel B. Linson.
