Liability For New York City Scooter Accidents
Scooters have become increasingly popular in New York City. But this has come with a sharp rise in scooter accidents. According to the Consumer Product Safety Commission, “As e-scooters, hoverboards and e-bikes become more popular for personal transportation and leisure activities, emergency departments are treating an increase in injuries nationwide. […] CPSC is also aware of 233 deaths associated with micromobility devices from 2017 through 2022, although reporting is ongoing and incomplete.” There are a number of factors that could contribute to a scooter accident.
- Scooter accidents tend to occur at intersections.
- Dimly lit roadways could contribute to a collision.
- A large number of fatal pedestrian accidents and scooter collisions involve intoxicated drivers.
All drivers have a duty of care to other drivers and pedestrians and must avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down in order to avoid hitting a scooter rider, this could form the basis of a negligence claim. Victims of scooter accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Scooter riders have a naturally small profile and are more likely to be overlooked. This is why it is so important for scooter riders to wear helmets and reflective clothing if possible. The family of any person who died in a scooter accident may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
