Liability For Brooklyn Bicycle Accidents
Bicycle accidents remain a major cause of preventable injury and death in the United States. According to the IIHS, “A total of 1,084 bicyclists were killed in crashes with motor vehicles in 2022, the highest number ever recorded. Bicyclist deaths have increased 8% since 1975, and have increased 75% since reaching their lowest point in 2010.” There are a number of common causes of bicycle accidents.
- Poor road conditions
- Speeding
- Dangerous left turns
- Inclement weather
All drivers and bicycle riders have a legal obligation to exercise due care in order to avoid collisions. To that end, all drivers and bicyclists must not operate their vehicles at a speed greater than would be reasonable or prudent given the prevailing conditions of the road. If a person fails to slow down to avoid a collision, this could form the basis of a negligence claim. Victims of bicycle accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Death
It is possible that a city could face civil liability for any bicycle accident. A city could be responsible for a collision if it was caused by a dangerous condition on public property. It is important that accident victims understand that they do have rights after a collision. The family of any person who died in a bicycle accident may have legal recourse through a civil claim.
