Liability for Putnam County ATV Accidents
Many people are seriously injured or killed in accidents involving ATVs and other off-road vehicles each year. According to the Consumer Product Safety Commission, “The dangers of riding off-highway vehicles (OHVs) are real and include overturning, collisions and occupant ejection. CPSC’s latest data show an annual average of more than 800 deaths and an estimated 100,000 emergency department-treated injuries involving OHVs.” Many different factors could contribute to ATV accidents.
- ATV accidents are more likely to take place if the ATV is not properly maintained.
- ATV accidents are more likely if the driver is speeding.
- ATV accidents may happen due to designed defects with the ATV itself.
Companies have a legal obligation to take steps to protect workers from foreseeable sources of harm. This necessitates that worksites are maintained in a reasonably safe condition. If an employer in New York failed to follow an industrial code that resulted in a worker being injured or killed, they could be held at fault for the accident. Victims of ATV accidents tend to suffer very serious injuries.
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
