Liability For New York City Car Accidents
Speeding remains one of the leading causes of car accidents in the United States. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2022, killing 12,151, or an average of over 33 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,922.” There are several other factors that could contribute to car accidents.
- Distracted driving
- Inclement weather
- Poor road conditions
- Driver intoxication
All drivers have a legal obligation to take steps to avoid hitting other vehicles. They must slow down when necessary and exercise caution when making turns. There is a rebuttable presumption of negligence on the part of any driver that leaves their own lane of traffic and collides with another vehicle in opposing lanes of traffic. Victims of car accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The vast majority of car accidents are preventable. They tend to involve instances where drivers are violating one or more traffic regulations. It is important for victims of car accidents to understand that they do have rights. Any person injured in a car accident may have legal recourse through a civil claim.
