Liability for New York City Garbage Truck Accidents

Commercial trucks are involved in many serious injury collisions each year. According to the National Safety Council, “A total of 5,472 people died in large-truck crashes in 2023. The number of deaths decreased 8% from 2022 but is up 40% in the last 10 years. The majority of deaths in large-truck crashes are occupants of other vehicles (70%), followed by truck occupants (18%), and non-occupants, primarily pedestrians and bicyclists (12%).” Truck drivers should take several actions to avoid collisions.

  • Truck drivers should check their blind spots before intersections.
  • Truck drivers should take periodic breaks to ensure that they are well rested.
  • Truck drivers should abstain from alcohol and other intoxicating substances.

Every driver in New York must exercise a great deal of care to avoid colliding with other vehicles. Among other things, they must maintain their vehicles at a safe speed and slow down to avoid colliding with pedestrians in traffic. If a garbage truck driver fails to exercise due care to avoid colliding with another vehicle, they could be held at fault through a civil claim. It is important that certain actions be taken after any garbage truck accident.

  • The police should be called to the scene of the crash so that they can begin an investigation.
  • Eyewitnesses should be interviewed.
  • Victims should seek a thorough medical evaluation.

The company that a garbage truck driver worked for could also be held at fault for a collision. As a general rule, employers in New York can be held vicariously liable for the wrongful actions of their employees–insofar as they were working within the course and scope of their job duties. Any person injured in a garbage truck accident may be able to seek some measure of justice through a civil claim.
