Liability for Long Island Truck Accidents
Distracted driving is one of the leading causes of car accidents in the United States. According to the National Highway Traffic Safety Administration, “Using a cell phone while driving creates enormous potential for deaths and injuries on U.S. roads. In 2022, 3,308 people were killed in motor vehicle crashes involving distracted drivers.” There are a number of other sources of potential driver distraction.
- Drivers can be distracted if they are trying to eat and drive.
- Drivers can be distracted when they are putting on makeup.
- Drivers can be distracted by trying to find objects that they drop while driving.
All drivers have a legal obligation to exercise due care and use caution in order to avoid collisions. Every driver must maintain a safe follow distance with the vehicle ahead of them. This follow distance should be particularly larger for trucks, since they have much longer stopping distances. There is a rebuttable presumption of negligence on the part of any truck driver that hits another vehicle in their own lane. Victims of truck accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Spinal cord trauma
- Death
Truck drivers are often put under an enormous amount of pressure to complete their routes as quickly as possible. This can often lead to dangerous situations where truck drivers become dangerously fatigued. In fact, one in ten truck drivers involved in a fatal collision reported feeling under pressure from their carrier. The family of any person who died in a collision may be able to seek some measure of justice through a civil claim.
