BROOKLYN, NEW YORK (November 10, 2024) – A 16-year-old child riding an e-bicycle tragically died in a Brooklyn truck accident on Ditmas Avenue.
New York City officials are saying that the collision took place around 1:54 p.m. on Monday. A driver was in a Hino box truck when he struck the victim while making a right turn.
Paramedics were called to the scene in order to help the victim. He was taken to Maimonides Hospital with critical injuries.
Sadly, he was later pronounced dead at the hospital.
Liability For Brooklyn Truck Accidents
Truck accidents remain very common in the United States. According to the National Safety Council, “In 2022, 5,837 large trucks were involved in a fatal crash, an 1.8% increase from 2021 and a 49% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is up 3% from 2021, and up 24% in the last 10 years.” There are several reasons that trucks can be particularly dangerous.
- Trucks have large blind spots that may obscure the presence of smaller vehicles and pedestrians.
- Trucks have a high center of gravity, which can lead to pedestrians and cyclists being pulled under.
- Trucks take much longer to stop at higher speeds.
Truck drivers will often need to get a commercial license and are held to a high standard in terms of safety. Many collisions involve drivers who fail to yield to other vehicles. According to New York VTL 1140, “The driver of a vehicle approaching an intersection shall yield the right of way to a vehicle which has entered the intersection from a different highway.” It is important that evidence is properly preserved after any collision.
- Surveillance footage should be sought.
- Eyewitnesses should be interviewed.
- A police report should be conducted.
- An experienced personal injury attorney should be contacted.
Truck accidents are often highly preventable. In many situations, certain intersections or roads can be particularly dangerous. Sadly, though, city officials are often slow to make changes that could help protect the public. It is crucial that victims of collisions understand that they do have rights. The family of any person who died in a truck accident may have legal recourse through a wrongful death claim.
