Scooter Rider Killed In Brooklyn Car Accident on Classon Avenue

The driver that hit the victim died due to their injuries. Police arrested the driver of the vehicle on suspicion of vehicular manslaughter.

Liability In Brooklyn Car Accidents

A large portion of car accidents involve drivers that are intoxicated or high on drugs. According to data from the NIH, “43.6 percent of fatally injured drivers in 2016 tested positive for drugs and over half of those drivers were positive for two or more drugs.” What many people don’t realize is that even prescription medications can potentially impair them. It can be hard to measure how many crashes are caused by drugged driving for many reasons.

  • Drugs often stay in a person’s system for many days, making it difficult to determine how it impaired their driving.
  • There aren’t any good roadside tests for drug use.
  • Many drivers have multiple drugs in their system, making it difficult to determine which may have impair them.

It is illegal to operate any vehicle while under the influence of drugs or alcohol. Any driver that causes an accident while under the influence of drugs can be held accountable through a criminal claim. They can also be held accountable through a civil claim. There are a number of steps that should be taken after any car accident.

  • Photos of the accident site should be taken.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral costs. Sadly, insurance companies will often fight hard to deny liability for any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
