Liability for Bay Shore Car Accidents
Drivers are supposed to exercise due care to avoid colliding with other vehicles. This requires that they maintain a safe speed. According to NY Veh & Traf L § 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” There are many ways that a driver may have acted negligently prior to a collision.
- A driver may have been distracted by looking at their phone or other objects.
- A driver may have been intoxicated by drugs or alcohol.
- A driver may have failed to maintain a safe following distance with other vehicles.
If a driver fails to slow down to avoid colliding with a pedestrian, this could be construed as negligence. There is a presumption of negligence on the part of any driver that drives onto a sidewalk and hits a pedestrian. Any person that is injured in a pedestrian accident may be able to pursue some measure of accountability through a personal injury claim. Damages in a civil claim can cover lost wages, medical bills, and pain and suffering.
