Liability For New York City Car Accidents
Thousands of pedestrians are killed or seriously injured every year in the United States. According to the National Highway Traffic and Safety Administration, “In 2022, 7,522 pedestrians were killed and more than 67,000 pedestrians were injured nationwide. NHTSA raises awareness of the dangers to pedestrians and provides tips to keep pedestrians safe.” There are a number of reasons that a pedestrian accident may take place.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
All drivers must use caution in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. Cities should take a number of measures in order to avoid pedestrian collisions.
- Cities should install pedestrian bridges in certain locations.
- Cities should ensure all intersections are well lit.
- Cities should study which intersections have the greatest history of collisions.
The vast majority of pedestrian accidents are preventable. Collisions tend to involve drivers that are distracted or not otherwise following traffic regulations. Sadly, though, drivers will often do everything in their power to deny liability if they cause a fatal collision. The family of any person that died in a collision may have legal recourse through a civil claim.
