Liability for Union City Car Accidents
Drivers must use caution to avoid hitting pedestrians in the roadway. According to NJ Rev Stat § 39:4-36, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any unmarked crosswalk at an intersection, except at crosswalks when the movement of traffic is being regulated by police officers or traffic control signals.” Drivers should take several measures to avoid pedestrians.
- Drivers must continuously scan the road ahead of them to avoid hazards.
- Drivers must check their blind spots before making turns at intersections.
- Drivers must use their horn to alert pedestrians of their presence in certain situations.
Even if a pedestrian is outside of a marked crosswalk, drivers must still use caution to avoid hitting them. When a driver fails to slow down to avoid hitting a pedestrian in the roadway, this may be construed as negligence. Any person injured in a pedestrian collision may be able to seek some measure of justice and accountability through a civil claim. This right extends to the family members of any person who died due to the negligent actions of another driver.
