Liability for New Jersey Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured in motor vehicle collisions every year in the United States. According to the Governors Highway Safety Association, “Drivers hit and killed 3,304 people walking in the United States in the first half of 2024, down 2.6% from the year before but a staggering 48% above a decade ago, according to a new analysis from GHSA.” There are many common causes of pedestrian accidents.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
Drivers have a legal obligation to exercise due care to avoid colliding with any pedestrians. They should be particularly cautious when they are making turns. A number of pedestrian collisions involve drivers that fail to check intersections as they are making left turns. If a driver fails to exercise due care and hits a pedestrian, this could form the basis of a negligence claim. Certain steps should be taken after any pedestrian crash.
- The police should be called to the scene so that they can begin an investigation.
- Eyewitnesses should be interviewed.
- Medical records related to the incident should be collected.
The vast majority of pedestrian collisions are preventable. They tend to involve situations where drivers are simply not paying adequate attention to the road ahead of them. This is particularly true during periods of reduced visibility. Drivers are simply not expecting to encounter pedestrians in many situations. But this does not absolve them of their responsibility to slow down and avoid collisions.
