Liability for Long Island Pedestrian Accidents

Far too many pedestrians are killed or seriously injured every year in New York. According to the New York State Department of Health, “Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” There are many factors that may cause accidents.

  • Pedestrian accidents tend to involve a speeding driver.
  • Pedestrian accidents often occur in the early morning hours when visibility is reduced.
  • Pedestrian accidents are more likely when drivers are distracted.

Drivers must use caution to avoid colliding with any pedestrian in the roadway. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid colliding with a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Death

There could be several liable parties after any pedestrian accident. This is particularly true if a driver was working at the time of a collision. In New York, drivers are held vicariously liable for the wrongful actions of their employers who are operating in the course and scope of their job duties. The family of any person that died in a pedestrian collision may have legal recourse through a civil claim.
